TERMS AND CONDITIONS
1. Validity:
All quotations and contracts concluded with us are based exclusively on the following conditions.
We do not recognise any other terms and conditions, even if these are not explicitly opposed. Any changes or additions to these terms and conditions or to contracts, including verbal agreements, are invalid until confirmed by us in writing. By placing an order with us, the purchaser formally accepts our terms.
2. Concluding a Contract:
Our quotations and particulars are without obligation and subject to confirmation. They can be changed at any time without any specific advice. We reserve the right to correct any subsequent mistakes or typing errors in our correspondence.
3. Price:
All prices are retail prices and include the corresponding legally required VAT (Value Added Tax). Our prices are calculated in Euros. When a new price list is published, all preceding price lists become invalid.
4. Payments:
Payments to be made exclusively in Euros without any charges to us. Invoices are payable in full upon receipt, provided no other written agreement has been accepted. We are not obliged to make any deliveries or provide any services before payment of any outstanding invoiced amounts. In the event of late payment, we will charge interest on arrears of 4% above the prevailing discount rate of the Austrian Federal Bank.
5. Defects, Warranty, Liability:
The purchaser must check the goods immediately after receipt and inform us of any defects in writing within 5 days after receipt. Under our warranty, it is at our discretion to replace, repair or make an appropriate refund. Parts subject to wear and tear are to be paid for at the customer’s expense. The warranty period becomes null and void, if the delivered item is modified or repaired without our consent, unless the modification or repair is carried out correctly. We are only liable for the purchaser’s damages, if we or our agents are liable for wilful misconduct or gross negligence, irrespective of the legal grounds supporting the claim. Any damages caused by us through gross negligence will be repaired unconditionally. In the case of improper use, the purchaser will not be eligible for a refund.
7. Retention of the Title:
Delivered items remain our property until payment of all demands arising from the business transaction between us and the client has been made in full. The purchaser may only sell on or pawn the goods, if he has paid in full. In the case of payment default, we reserve the right to recover the goods.
8. Guarantee:
We guarantee our products for two years. During the guarantee period we will rectify all defects caused by faulty materials or during manufacturing, on production of the original invoice. However, this does not include defects which can be attributed to normal wear and tear or improper use.
9. Place of Execution and Court of Jurisdiction, Applicable Law:
Place of execution for all contractual obligations is the Company’s registered office. The Court of Jurisdiction for all legal disputes arising from the contractual relationship will be determined by our Company’s registered office.
